The trial of the boyfriend accused of strangling his girlfriend to death last year has been pushed back to fall.
Leo Stapleton was arrested in late December after allegedly murdering Kimberly Clark in the apartment that they shared. Stapleton is also charged with burglary. Both charges have a repeat violent offender specification.
Stapleton's attorney is asking that the court not treat the two charges as a joint trial as it would be confusing and disallow for a fair trial. Judge David Cheney has not decided on that motion. Stapleton's attorney also asked for additional time to prepare for trial, saying the services of a local doctor will require more time. Judge Cheney agreed and set a new trial date for September 5, 2017.
